When preparing your case for trial, focus on your path. It’s no different from focusing on your path in the forest. You chose your path through the forest because it will take you where you want to go. To follow your chosen path simply focus on that path. If you focus on the trees instead of your path, you’ll likely lose your way. If you focus on the lions and tigers and bears - defense distractions - rather than your path you will most assuredly lose your way. Focus on your path.
After you uncover the story of your case and decide where you want to end up with your case, you’ll need to lay out your path to get there. Your story may change. Your path may change too. That’s all right. What’s critical is that you know your destination and you have a path that will get you there.
Your path for questioning a witness at trial, for instance, will start with what you want from that witness. Begin by asking yourself. “What do I want from this witness?” “What do we need from this witness to get us to our destination?” “How do we get that from this witness?” Over the next several weeks we’re going to look at finding your story, deciding on your destination, and on choosing your path and getting there - for Openings, Direct and Cross Examinations, and Closing Arguments. You’ll learn to choose your destination, create your path, and follow it. We may step off the path along the way.
